Female Indian civil judge seeks for justice

On December 15, 2023, a female judge of a civil court in northern india pleased to CJI to end her life(justice). She has put the sexual abuse accusation on her senior. 

Statements of an open letter shared by local media revealed on thursday – “I have no will to live anymore. I have been rendered a walking corpse in the last year and a half. There is no purpose in carrying this soulless and lifeless body around anymore. There is no purpose left in my life and asked for permission to end her life in a dignified way: let my life be dismissed” as no action has been taken in high court, stated the judge whose name hasn’t disclosed yet.   

A female civil judge in junior division in Uttar Pradesh has raised a sensitive issue in judicial circle and she penned down a very disturbing open letter to CJI DY Chandrachud to give her permission to end her life. She alleged that she was sexually harassed by a district judge and his associates; she went to high court for the justice for herself. Despite taking any further action, court has dismissed the case. Being a judge herself, she is not able to take justice.   

The letter shows the intensity of the case and her trauma. The letter written in extreme pain with a distressed feeling addressed to Chief Justice of India D.Y.Chandrachud. 

As the letter was prevalent on social media on friday December 15, 2023, CJI Chandrachud sought a status report from Admin of Allahabad high court on the conducted inquiry in regard of sexual harassment case raised by the female civil judge. The CJI is holding him back to respond on this matter.

No system of redressal

It is written in that revealed letter that “I have been sexually harassed by one particular district judge and his associates. I was told to meet the district judge at night,” stated in her letter. 

However, she does not state the specific event or names of the accused. This letter shows a clear chaos of her experience what she had to bear and go through for justice. The price she paid off for justice being a judge is so shameful for our country.

She also alleged that she was being abused verbally in open court with a misogynist tone and she tried to kill herself through suicide. The judge tolerated the harassment and misbehave during her earlier days of posting in another district near Lucknow. 

She also used these words to express her grievance: “I have been sexually harassed to the very limit. I have been treated like utter garbage. I feel like an unwanted insect. And I hoped to provide justice to others. What naive me!” she stated in her letter.

The identity and location of the victim are not disclosed as it is the matter of her safety mandated by law. The reason why woman is highly depressed by the decision of Allahabad High Court and administrative judge is that no action has been taken till now. Nobody is even bothered why she was distressed, all being insouciant as the voice of woman doesn’t matter for the people of our nation.  

Infact, in the month of july, 2023 first time she complained to the internal committee (ICC) of high court but it took a prolonged period of six months and after sending a thousand emails” just to conduct an inquiry, she stated.    

She also states “ the conducted enquiry is also a farce and a sham. The testimonies in enquiry are immediate subordinates of the district judge,” due to this argument she appealed for a fair enquiry the witnesses must not be in the administrative control of the defence clients. 

“How the committee anticipates the testimonies to depose against their boss is beyond my understanding”.

The civil judge said that she had also requested for the accused district judge’s transfer till the time of pendency of the enquiry.

Petition is dismissed at Supreme Court

After getting no response from High Court she appealed in Supreme Court with a hope. A bench of Justice Hrishikesh Roy and Sandeep Mehta on december 13, 2023, repealed a writ petition filed by her saying that her case was under process of the International Criminal Court.  

The court said that As the matter of the fact internal complaints committee concerned is in session of the matter and a resolution is passed which is actually pending approval of Chief Justice of Allahabad High Court, this writ petition under Article 32 of the constitution wouldn’t be entertained. 

Her message for the other working women of the India:

She exclaimed with sorrow at the dismissal of Supreme Court for her petition and alleged that her plea was rescinded in eight seconds.

” I thought that the highest court will definitely hear such a straight forward benign prayer. What did I know? My writ petition was dismissed in 8 seconds without any hearing and consideration of my prayers,” she stated in that open letter.

The victim judge expressed her concern for a fair enquiry in her matter. “What Justice will I give to others when I am feeling pessimistic?”

Through her letter, the civil judge also shared a message for working women of the country, warned all the women of the tall order to deal with the law system and fight against the irrelevant acts until you get the justice.

She also stated  that “learn to live with sexual harassment. It’s a truth of our lives. The POSH ACT is a big wholesome which we have to belie for our survival. No one listens, no one bothers….And I am a judge. She is in profound grief as she could not get the justice for herself. I advise all the women to learn to be a toy, or a non-living thing.”
